What to check before buying a creekfront property

Creeks and streams can be lovely and also unpredictable: many run low or dry in some seasons and rise quickly after storms. A creek can carry its own setback, wetland or floodplain rules, and ownership of the creek bed varies by state.

  • Does the creek run year-round, and how high does it get after heavy rain?
  • Is any part of the lot in a mapped floodplain or a mapped wetland? Mapped features are a starting point, not a determination.
  • Are there setbacks from the creek for building, septic or clearing?
  • Who owns the creek bed, and does anyone else have rights along it?
